Welcome to WorkIt. These Terms of Service ("Terms") govern your access to and use of our social media management platform. By using WorkIt, you agree to these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using WorkIt, you confirm that:
- You have read and understood these Terms
- You are at least 16 years of age
- You have the legal capacity to enter into this agreement
- You agree to comply with all terms and conditions
If you do not agree to these Terms, you must not use our platform.
2. Description of Service
WorkIt is a social media management platform that allows you to:
- Connect and manage multiple social media accounts
- Create, schedule, and publish content across platforms
- Access analytics and performance insights
- Collaborate with team members
- Discover trending topics and content ideas
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.
3. Account Registration
3.1 Account Creation
To use WorkIt, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
3.2 Third-Party Authentication
If you use third-party services (such as Facebook, Google) to sign in, you authorize us to access certain account information as permitted by those services.
4. Acceptable Use Policy
You agree NOT to use WorkIt to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Post or distribute illegal, harmful, threatening, abusive, or defamatory content
- Engage in spam, phishing, or fraudulent activities
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with the proper functioning of the platform
- Use automated tools to access the service without permission
- Circumvent any rate limits or usage restrictions
- Impersonate others or misrepresent your identity
5. Social Platform Compliance
When using WorkIt to manage your social media accounts, you must:
- Comply with the terms of service of each connected platform (Facebook, Instagram, LinkedIn, TikTok, Pinterest, Threads, etc.)
- Ensure you have the necessary rights and permissions to post content
- Not engage in activities that violate platform policies (fake engagement, spam, etc.)
- Keep your social account credentials secure
We are not responsible for any actions taken by social platforms against your accounts due to your content or activities.
6. Content Ownership
6.1 Your Content
You retain full ownership of all content you create, upload, or publish through WorkIt. By using our service, you grant us a limited, non-exclusive license to:
- Store and process your content to provide the service
- Display your content within the platform
- Transmit your content to connected social platforms
- Create backups of your content
This license terminates when you delete your content or close your account.
6.2 Responsibility for Content
You are solely responsible for the content you create and publish. You represent that you have all necessary rights to use and publish your content.
7. AI-Generated Content
WorkIt may offer AI-powered features to assist with content creation. Regarding AI-generated content:
- AI suggestions are provided as assistance only; you are responsible for reviewing and approving all content before publishing
- We do not guarantee the accuracy, appropriateness, or originality of AI-generated suggestions
- You should verify that AI-generated content complies with platform policies and applicable laws
- You remain fully responsible for any content you publish, regardless of whether it was AI-assisted
8. Intellectual Property
WorkIt and its entire contents, features, and functionality are owned by WorkIt and are protected by international copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or distribute our platform or its content
- Use our trademarks without written permission
- Reverse engineer or attempt to extract our source code
- Remove any proprietary notices from our materials
9. Privacy
Your privacy is important to us. Your use of WorkIt is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Limitation of Liability
To the maximum extent permitted by law:
- WorkIt is provided "as is" without warranties of any kind, express or implied
- We do not guarantee uninterrupted, error-free, or secure access to the service
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for actions taken by social platforms against your accounts
11. Indemnification
You agree to indemnify and hold harmless WorkIt, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you create or publish through the platform
12. Termination
12.1 By You
You may terminate your account at any time through your account settings or by contacting us. See our Data Deletion page for details.
12.2 By Us
We may suspend or terminate your access if:
- You violate these Terms
- Your conduct harms other users or the platform
- Required by law
- At our sole discretion with reasonable notice
12.3 Effects of Termination
Upon termination, your right to use WorkIt ends immediately. We will delete your data according to our data retention policy.
13. Modifications to Terms
We may modify these Terms at any time. We will notify you of significant changes via email or through the platform at least 30 days before they take effect. Your continued use after changes constitutes acceptance of the new Terms.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of France. Any disputes shall be submitted to the exclusive jurisdiction of the courts of France, without prejudice to your rights as a consumer under applicable law.
15. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and WorkIt.
- Severability: If any provision is found invalid, the remaining provisions remain in effect.
- Waiver: Failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign these Terms without our consent.
